Terms of Service

FitIntel is provided by FitIntel Core Ltd, a company incorporated in the United Kingdom, trading as FitIntel. When you use the service, your agreement is with FitIntel Core Ltd. You can contact us at contact@fitintelapp.com.

FitIntel is a fitness accountability and tracking service. It uses information you supply or record, such as weight, calories, activity and steps, to provide personalised fitness targets, insights, guidance and recommendations.

Everything FitIntel produces is a recommendation, not a requirement or a prescription. You decide whether to follow any target, insight, recommendation or piece of guidance the service provides.

FitIntel is a fitness accountability and tracking service. It uses information supplied or recorded by you to provide personalised fitness targets, insights, guidance and recommendations. These may include recommendations relating to calorie targets, activity and step targets, weight goals, fitness progress, behavioural consistency and other fitness or accountability metrics available within the service.

All of these outputs are recommendations. They are not requirements, instructions or prescriptions. You remain responsible for deciding whether to follow any target, recommendation, insight or guidance provided by FitIntel.

FitIntel does not provide medical advice, medical diagnosis, medical treatment or medical nutrition therapy. Our calorie and nutrition-related recommendations are generated for general fitness and accountability purposes, based on the information you supply or record. They are not prescribed diets and are not medical nutritional recommendations.

If you have a medical condition, prescribed dietary requirements, are pregnant, have a current or previous eating disorder, or have any other circumstance that could materially affect your nutritional or physical activity requirements, please seek advice from an appropriately qualified healthcare professional before making significant changes to your diet or exercise.

FitIntel is not a substitute for professional medical advice, diagnosis or treatment. Never disregard or delay seeking professional medical advice because of something you have read or seen in the service.

FitIntel's recommendations and insights depend in part on the information you supply or record. You are responsible for providing reasonably accurate information and keeping it up to date.

Information that is inaccurate, incomplete, outdated or inconsistent may affect the relevance and accuracy of the targets, insights and recommendations FitIntel produces.

We do not guarantee weight loss, weight gain, weight maintenance, fitness improvement or any other specific outcome. Individual results vary depending on many factors, including factors outside the service and outside our control.

You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account. Please tell us promptly if you believe your account has been used without your permission.

Some features are offered on a paid subscription basis. The price, billing cadence, renewal terms and included features are those presented to you at the point of purchase. Subscriptions renew automatically for the stated period until cancelled.

Where you purchase a subscription through the Apple App Store, billing, renewal, cancellation and refunds are handled by Apple and are also subject to Apple's terms and App Store procedures. In that case you manage or cancel your subscription in your Apple account settings, and refund requests are made to Apple. FitIntel Core Ltd cannot process or reverse a charge made through Apple on your behalf.

Where you purchase a subscription directly from FitIntel Core Ltd, you can manage or cancel it in your account settings, and you can contact us about refunds at contact@fitintelapp.com.

Cancelling stops future renewals; access continues until the end of the period you have already paid for. Nothing in this section affects any statutory cancellation or refund rights you have as a consumer under the law applicable to you.

You agree not to misuse FitIntel. In particular, you must not attempt to gain unauthorised access to the service, other accounts or our systems; interfere with, disrupt or place unreasonable load on the service; probe, scan or circumvent security or access controls; reverse engineer or copy the service except where permitted by law; or use the service for unlawful, fraudulent or abusive purposes.

You retain ownership of the personal data and content you submit to FitIntel. You grant FitIntel Core Ltd the rights reasonably necessary to host, process and analyse that information for the purpose of providing, operating, securing and supporting the service for you.

We do not sell your personal fitness data, and we do not use it for unrelated commercial purposes. How we handle personal data is described in our Privacy Policy, which forms part of your agreement with us.

FitIntel Core Ltd owns, or is licensed to use, all intellectual property rights in the service. This includes the FitIntel brand and logos, the product design and user interface, the software and source code, and the content we provide within the service.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the service for your own personal, non-commercial use in accordance with these terms. No other rights are granted.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. These terms do not affect your statutory rights as a consumer.

Subject to that, and to the maximum extent permitted by law, FitIntel Core Ltd is not liable for indirect, incidental, special, consequential or punitive losses, or for loss of profit, revenue, data or anticipated savings, arising from your use of the service.

As set out in the Health & Fitness Disclaimer, FitIntel does not provide medical advice, diagnosis, treatment or medical nutrition therapy, and its targets, insights and recommendations are recommendations only. Together with the section on your information and recommendation accuracy, that means we are not responsible for decisions you take about your diet, training or health, or for outcomes that result from information you supply that is inaccurate, incomplete or out of date.

The service is provided with reasonable care and skill, but we do not warrant that it will be uninterrupted or error free. To the extent permitted by law, our total liability arising out of or in connection with the service is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim.

You may stop using FitIntel and close your account at any time. We may suspend or terminate access where reasonably necessary, including for serious or repeated breach of these terms, security risks, fraud or abuse, or to comply with a legal requirement. Where it is reasonable and lawful to do so, we will give you notice. Suspension or termination does not affect your statutory rights or any refund you are entitled to by law.

We may update these terms from time to time, for example to reflect changes to the service or to legal requirements. If a change is material, we will give you reasonable notice. Continuing to use FitIntel after a change takes effect means you accept the updated terms.

These terms and any dispute or claim arising out of them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections available to you under the law of your country of residence, and you may also be able to bring proceedings in the courts there.
